At the tender age of 18, Banks was falsely accused of rape by his classmate, Wanetta Gibson. All his efforts to show that he was not guilty proved futile. He was accused of not just assault but also kidnapping after the two parties had a consensual encounter on the school campus. The girl’s parents then sued the long beach unified school district claiming that the school environment was unsafe for their daughter. The family received a settlement of about $1.5 million.

Brian banks had to choose between fighting the charges and risk spending 41 years in prison or just take a plea deal and spend only 5 years in prison confinement. He had to choose the second option even though he wasn’t guilty. He ended up spending 6 years in prison with 5 years probationary period.

After the Los Angeles district attorney’s office launched an investigation into the case, the new evidence was reviewed and it was concluded that Brian Banks was wrongfully convicted. Judge Mark C. Kim of the superior court reversed the footballer’s conviction on Thursday, May 24, 2012.
